Terms of Service

1. Agreement to terms

By accessing or using the Layer Insights platform (layerinsights.io and app.layerinsights.io), you agree to be bound by these Terms of Service and our Privacy Policy. Layer Insights is operated by MGR Products BV, registered in Amsterdam, Netherlands.

2. Use of the platform

Layer Insights provides e-commerce intelligence software for Shopify merchants. You may use the platform only for lawful purposes. You agree not to reverse engineer, decompile, or disassemble any part of the platform, or interfere with its integrity or performance.

3. Accounts and subscriptions

Subscription fees are billed in advance on a monthly or yearly basis. All fees are non-refundable except as provided in our 30-day money-back guarantee for new paid subscriptions. We reserve the right to change subscription fees with 30 days notice.

4. Data processing

When you install the Layer Insights Shopify App, you authorize us to process e-commerce and customer event data on your behalf as a data processor under GDPR Article 28. You remain the data controller for your customers personal data and are responsible for obtaining appropriate consent.

5. Ad platform integrations

Layer Insights dispatches event data to third-party advertising platforms (Meta, Google, TikTok, Pinterest, Snapchat, LinkedIn) as instructed by you. You are responsible for ensuring your use of these integrations complies with each platforms terms of service and applicable privacy laws.

6. Intellectual property

The Layer Insights platform is owned by MGR Products BV and protected by intellectual property laws. You are granted a limited, non-exclusive license to use the platform for your own business purposes during your subscription period.

7. Limitation of liability

To the fullest extent permitted by law, MGR Products BV shall not be liable for any indirect, incidental, or consequential damages. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Termination

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. Upon termination, we will delete your data in accordance with our Privacy Policy.

9. Governing law

These terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of Amsterdam, Netherlands.
